Terms and Conditions of Sale
These terms apply to every order you place through the shop on www.philotrophie.com. Please read them before you order. By placing an order you agree to them.
1. About us
The shop is run by Philotrophie Ltd, a company registered in England and Wales (company number 16142493). Our registered office is 71-75 Shelton Street, Covent Garden, London WC2H 9JQ. Our yoghurt is made at Unit 29c Groves Yard, Shipton Road, Milton under Wychwood OX7 6JP. You can reach us at saltfoodchronicles@gmail.com.
2. Our products
We sell traditional shepherd's yoghurt made from British non-homogenised sheep milk, set in reusable terracotta pots. Pots come in 250g, 500g and 1kg sizes. Photos and descriptions are a guide. The natural crust, colour, texture and tang vary from batch to batch and through the seasons, because we make the yoghurt without homogenising it.

3. Who can order
You must be 18 or over to place an order. These terms are for consumers. If you are buying for a business or to resell, please contact us for trade terms and a purchase order.
4. Placing an order and making the contract
Your order is an offer to buy. We accept it, and the contract begins, when we send you an order confirmation email. If we cannot accept an order, for example because we are out of stock or cannot deliver to you, we will tell you and refund anything you have paid.
You can cancel an order free of charge at any time before the order cut-off of midnight on the Friday before production, by emailing us.
5. Made in weekly batches
We make our yoghurt to order in small weekly batches on Mondays, and we order the milk for each batch in advance. Orders received by midnight on the Friday before are made on the Monday and ready for collection on Tuesday or Wednesday, or for delivery on [delivery day]. Orders received after the cut- off go into the following week's batch.
6. Prices and VAT
Prices are shown in pounds sterling on the shop pages. [No VAT is currently charged on our products.]
We may change prices at any time, but a change will not affect an order we have already confirmed. If we spot a pricing mistake, we will tell you before we accept your order and you can choose to go ahead at the correct price or cancel.
7. Pot return discount
Our pots are reusable, and we reward you for returning them. You get 50p off for each 250g pot, 75p off for each 500g pot and £1 off for each 1kg pot you return. The discount applies from your second order. Hand your clean pots back at your next collection or delivery, and we will take the discount off that order. We may refuse a returned pot that is cracked, chipped or not clean, and we cannot give a discount for it. The pot is yours once you have paid, and returning it is optional.
8. Collection and delivery
Collection. You can collect from Unit 29c, Groves Yard, Milton under Wychwood OX7 6JP on Tuesdays or Wednesdays, at the time we confirm. Delivery. [We deliver within around 30 miles of Milton under Wychwood on Wednesdays and
Thursdays. Delivery charges, if any, are shown at checkout.] We will give you a delivery window and ask you to name someone who can receive the order. Our yoghurt is fresh and chilled, so please collect or receive it promptly and put it in the fridge straight
away. If nobody is available to receive a delivery, we will try to contact you. We cannot leave chilled food unattended, so a missed delivery may mean the yoghurt cannot be kept. In that case we may be unable to refund or replace it, unless the delay was our fault. Ownership of the goods passes to you, and they become your responsibility, once you have paid and have collected or received them.
9. Storage, use-by and allergens
Keep the yoghurt refrigerated and eat it by the use-by date on the pot. Once opened, keep it covered in the fridge. Allergens. Our yoghurt contains milk. Allergens are shown in bold on the pot label. If you or anyone you are buying for has an allergy or intolerance, please read the label and contact us before ordering if you have questions. The information on our website and packaging is general food information. It is not medical or nutritional advice.
10. Payment
You pay through our website, which is built on Wix, using the payment methods shown at checkout. Payment is taken when you place your order unless we tell you otherwise at checkout. We do not see or store your full card details.
11. Weekly subscriptions
If you set up a weekly subscription, we will prepare your usual order each week and collect payment each week through the website using the payment method you saved at checkout. You can pause, change or cancel a subscription by emailing us before the cut-off of midnight on the Friday before the Monday batch. Changes after the cut-off apply from the week after.
12. Your right to cancel after we accept an order
Because our yoghurt is fresh food that spoils quickly, and is made to order for you, the 14-day cancellation right in the Consumer Contracts Regulations 2013 does not apply once we have accepted your order. This does not affect your other rights, including your rights under section 13.
13. Problems with your order
We must supply goods that are as described, of satisfactory quality and fit for their purpose, and your legal rights under the Consumer Rights Act 2015 are not affected by these terms. If something is wrong, for example a damaged pot or yoghurt that has gone off before its use-by date, email us as soon as you can with your order details and a photo if possible. We will offer a replacement or a refund, whichever you prefer where the law allows. Refunds go back to the original payment method within 14 days of us agreeing to it.
14. Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, we are responsible for losses that are a foreseeable result of us breaking these terms, and we are not liable for business losses or for loss that was not foreseeable. Our total liability for any order will not exceed the price you paid for it. We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, illness in our small team, supplier problems, or transport disruption. We will tell you as soon as we can and offer a fair remedy.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring a claim in the courts of your home country.
